1. Who we are

The website asiafest.eu (the “Website”) is owned and operated by:

referred to below as the “Organiser“, “we” or “AsiaFest“.

The Organiser runs the ASIA FEST festival and its related events (the “Event” or the “Festival“).

2. Definitions

User — any person accessing the Website, whether or not they submit data through the available forms.

Attendee — any person admitted to the Event venue on the basis of a valid ticket or accreditation.

Content — text, images, video and audio materials, graphics, logos, databases and any other materials published on the Website.

Ticketing Partner — the external operator through which tickets for the Event are sold online.

3. Acceptance of these terms

By accessing and using the Website, you confirm that you have read, understood and accept these Terms and Conditions. If you do not agree with them, please do not use the Website.

These Terms are supplemented by the Privacy Policy and the Cookie Policy, which form an integral part of this document.

If you are under 16, you may use the Website and submit data through the available forms only with the consent of a parent or legal guardian.

4. Use of the Website

The Website is informational in nature: it presents the Festival programme, the artists, exhibitors, partners and practical attendance information.

We grant you a limited, non-exclusive and revocable right to access and consult the Website for personal, non-commercial purposes.

You may not:

  • use the Website for any unlawful purpose or in a way that infringes third-party rights;
  • copy, reproduce, distribute or commercially exploit the Content without our prior written consent;
  • automatically extract data from the Website (scraping, crawling, data mining) without our written consent;
  • attempt to gain unauthorised access to the Website, our servers or our databases;
  • transmit viruses, malicious code or anything that may affect the operation of the Website;
  • submit false or misleading information through the Website’s forms, or information belonging to another person without their consent.

We reserve the right to restrict access for any User who breaches these rules.

5. Intellectual property

All Content on the Website, as well as the “ASIA FEST” name, logo and visual identity, are protected by copyright and industrial property law and belong to the Organiser or its partners, as applicable.

Photographs of artists, partners and exhibitors are published with the rights holders’ consent and remain their property.

Nothing in these Terms transfers any intellectual property right to you. Reuse of materials for journalistic purposes is permitted with attribution to the source (“asiafest.eu”) and, where applicable, to the photographer.

6. Tickets and Event access

6.1 How to buy

Tickets for the Event can be purchased:

  • online, through the Ticketing Partner;
  • on site, at the Event box office.

6.2 Online purchases are made from a third party

The Organiser does not sell tickets directly through the Website. “Buy ticket” buttons and links redirect you to the Ticketing Partner’s platform.

The ticket sale contract is concluded between you and the Ticketing Partner, under the terms set by them. The Ticketing Partner’s terms, conditions, payment, invoicing and refund policies apply in full to these transactions, and we recommend reading them before purchasing.

The Organiser is not liable for the operation of the Ticketing Partner’s platform, for payment processing, or for any errors occurring during the online purchase process.

6.3 Prices

Ticket prices are displayed on the Website for information purposes, in Romanian lei (RON), VAT included. The applicable price is the one displayed by the Ticketing Partner at the time of purchase, or the one displayed at the box office.

We reserve the right to change prices and to introduce or withdraw ticket categories. Changes do not affect tickets already purchased.

6.4 Right of withdrawal

Under Article 16(l) of Romanian Government Emergency Ordinance no. 34/2014, the 14-day right of withdrawal does not apply to contracts for leisure services with a specific date or period of performance. Event tickets fall into this category and therefore cannot be returned simply because you changed your mind.

6.5 Cancellation, rescheduling, programme changes

The artistic programme and the lists of artists, exhibitors and activities are indicative and may change for reasons beyond the Organiser’s control. Such changes do not entitle you to a refund.

6.6 Ticket validity

A ticket is valid for a single entry, for the day or period printed on it. Damaged, illegible or duplicated tickets, or tickets purchased from sources other than those listed in 6.1, are invalid and do not grant access.

Commercial resale of tickets without the Organiser’s written consent is prohibited.

7. Venue rules and conduct

Access to the Event venue requires a valid ticket and compliance with the venue’s regulations.

The Organiser reserves the right to refuse entry or to require a person to leave the venue, without refunding the ticket price, if they:

  • are under the influence of alcohol or prohibited substances;
  • behave aggressively or in a discriminatory manner, or endanger the safety of other attendees;
  • refuse the security check at the entrance;
  • attempt to bring prohibited items into the venue.

It is prohibited to bring into the venue weapons, blunt or sharp objects, flammable substances, pyrotechnics, prohibited substances, outside food and drink, or any item deemed dangerous by security staff.

Attendance is at your own risk. The Organiser is not liable for personal belongings lost, stolen or damaged at the venue.

8. Photography and filming

Photographs and video recordings are made during the Event for documentation, promotional and archival purposes.

By entering the venue, Attendees acknowledge that they may appear in such materials, in general crowd shots, and that these may be published on the Website, on the Festival’s social media channels and in press or promotional materials.

If you appear in a photograph or recording in a way that individually identifies you and you wish it to be removed, you may write to the address in section 15 and we will review your request. Details on the legal basis for processing and on your rights are set out in the Privacy Policy.

9. Forms available on the Website

The Website provides forms for:

  • exhibitor registration — traders, restaurants, food trucks, cultural centres and other entities interested in taking a stand;
  • volunteer registration;
  • contact — general questions and requests.

By completing a form, you warrant that the information submitted is true, complete and up to date.

Submitting a form does not constitute a confirmed registration. It is a request that the Organiser reviews and may accept or reject, without any obligation to give reasons. A contractual relationship between the Organiser and an exhibitor or volunteer arises only upon our express confirmation and, where applicable, the signing of a separate contract.

Data submitted through forms is processed in accordance with the Privacy Policy.

10. Personal data protection

We process personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable national law.

11. Cookies

The Website uses cookies and similar technologies. Details on the types of cookies used and how to manage your preferences are set out in our Cookie Policy

12. Limitation of liability

The Website and its Content are provided “as is”. We make reasonable efforts to keep the published information accurate and up to date, but we do not warrant that it is free of errors or omissions.

The Organiser is not liable for:

  • temporary interruptions in the operation of the Website caused by maintenance, technical faults or external factors;
  • the content of third-party websites linked from the Website, including the Ticketing Partner’s platform, social networks, and partner and artist websites;
  • indirect damages resulting from the use of, or inability to use, the Website.

Nothing in this section limits the Organiser’s liability where the law does not permit such limitation, including in cases of wilful misconduct, gross negligence or personal injury.

13. Force majeure

The Organiser is not liable for failure to perform its obligations where this is due to force majeure or a fortuitous event within the meaning of Article 1351 of the Romanian Civil Code — including, without limitation: extreme weather, natural disasters, fire, restrictions imposed by authorities, states of emergency or alert, armed conflict, general strikes.

14. Governing law and dispute resolution

These Terms are governed by Romanian law.

We encourage you to contact us first — most situations are resolved quickly and amicably.

If we cannot reach a solution, you may contact the National Authority for Consumer Protection (ANPC)anpc.ro — including its Alternative Dispute Resolution (SAL) Directorate, under Romanian Government Ordinance no. 38/2015.

Disputes not settled amicably fall within the jurisdiction of the Romanian courts.

15. Changes to these Terms and contact

We reserve the right to amend these Terms. The updated version is published on this page, stating the date of the last update. Continued use of the Website after publication constitutes acceptance of the amended version.
